  1. Eligibility: RANLife's $120k Giveaway Sweepstakes (the "Giveaway") is open only to legal residents of the twenty six states of the United States of America in which RANLife is licensed to do business. Residents of the following states are excluded from this promotion: CT, DE, DC, GA, IA, KS, LA, ME, MN, MS, MT, NH, NJ, NY, NC, ND, OH, PA, RI, SC, SD, VT, WV, WI and WY. Participants must be at least eighteen years of age at the time of entry. Employees of RANLife, Inc. (or their branches or affiliate companies) and their immediate family and household members are ineligible to participate. Entries are limited to the first four thousand entries for each Drawing Period. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to this Prize Notice of Official Rules (the “Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth in these official rules.
  2. Sponsor and Solicitor (the “Sponsor”): RANLife, Inc., 268 W 400 S, Salt Lake City, UT 84101.
  3. Timing: The Giveaway begins on November 22, 2010 at 12:00 a.m. Mountain Standard Time ("MST") and ends on January 31, 2011 at 11:59 p.m. MST (the "Extended Promotion Period"). There will be exactly twelve monthly grand prize Drawings (the "Drawings") throughout the Extended Promotion Period, corresponding exactly to twelve Drawing Periods (the "Drawing Periods"). The first Drawing Period will begin on November 22, 2010 at 12:00 a.m. MST and end on January 31, 2011 at 11:59 pm. Each subsequent Drawing Period (i.e., Drawing Periods two through twelve) will begin at 12:00 a.m. MST on the first day of each calendar month and end at 11:59 p.m. MST on the last day of the same calendar month throughout the remainder of the Extended Promotion Period. The Drawings for each Drawing Period will take place on or about the first Monday (excluding federal holidays) of the calendar month immediately following the corresponding Drawing Period. The first Drawing will take place on or about February 7, 2011 for the Drawing Period ending January 31, 2011 and the last Drawing will take place on or about January 9th, 2012 for the Drawing Period ending December 31, 2011.
  4. Discontinuation of or modification to the Giveaway: The Sponsor reserves the right to discontinue or modify the Giveaway for future Drawing Periods subsequent to the first Drawing Period and throughout the remainder of the Extended Promotion Period so long as advance notice is given wherever the Giveaway had been advertized at least two weeks prior to the start of the next Drawing Period. Once any Drawing Period has begun and entries have been taken, Sponsor agrees to conduct the Drawing for that Drawing Period in accordance with these Official Rules, including the payment of the Grand Prize to the winner for that Drawing Period. Following the discontinuation or modification of the Giveaway, these Official Rules will no longer apply without a written amendment, if any, by the Sponsor. In the case that Sponsor elects to discontinue the Giveaway for future drawing periods, these Official Rules will be voided at midnight on the last calendar day of the final Drawing Period in which notice of discontinuation is given.
  5. The Drawings: The Judge of the Drawings (the “Judge”) has no financial stake in RANLife and is appointed by RANLife to act as an independent Judge with no personal interest in the outcome of the drawings. Different Judges may be appointed for each Drawing due to the long timeframe of the Extended Promotion Period. Judge’s decisions as to the administration and operation of the Drawings and the selection of the potential winners are final and binding in all matters related to the Drawings. The Judge for each drawing will randomly select the potential Giveaway Finalist Prize winners from all eligible entries received during the Drawing Period on the day of the Drawing. The potential Finalist Prize winners will be notified by phone, mail and/or email. Each potential Finalist Prize winner will be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit"), which must be received by Sponsor within ten (10) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential Finalist Prize winner cannot be contacted, or fails to sign and return the Affidavit within the required time period, potential winner forfeits prize. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential Finalist Prize winner is disqualified for any reason prior to thirty (30) days from the Drawing or the payment of the Grand Prize for that Drawing Period, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries for the same Drawing Period, time permitting. Only three (3) alternate drawings will be held within the thirty (30) day period after the initial Drawing for that Drawing Period, after which the prize for that Drawing Period will remain un-awarded.
  6. Prizes: TWELVE (12) GRAND PRIZES: Each Grand Prize is $10,000 paid by Sponsor towards Winner’s RANLife originated mortgage. Net Verifiable Retail Value ("VRV"): $5,000. In the event that Winner does not have a mortgage loan that was originated through RANLife or would prefer not to have a payment made towards his/her mortgage by Sponsor, Winner may elect to receive the VRV of $5,000 awarded in the form of a check to winner. Each Grand Prize will be awarded within thirty (30) days from the date of the Drawing for each Drawing Period.
  7. Odds of winning: Odds of winning are greater than 1:4,000 for each Drawing. Odds of winning depends on number of entries received, not number of written prize notices distributed. No printed version of this written prize notice exists beyond the electronic version here on this webpage, except when a printed copy is requested by a customer in the course of a phone call. Number of written prize notices, therefore, will vary according to the actual number of visitors to this webpage that view this document. Since entries are capped at four thousand (4,000) for each drawing, odds of winning will always be greater than one (1) in four thousand (4,000).
  8. How to Enter: There are three (3) ways to enter the Giveaway. Entries will only be valid from one of these sources:
  9. Limit to Number of Entries: Each participant may enter only one (1) time and for only one Drawing throughout the duration of the Extended Promotion Period, regardless of the method of entry. Once the Drawing Period for which the participant has entered has elapsed, that participant is ineligible for all future Drawing Periods throughout the remainder of the Extended Promotion Period. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different identities, registrations, mortgage applications or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Additionally, only four thousand entries will be accepted for each individual Drawing period. Once the four thousand entry limit has been reached, any remaining and otherwise eligible entries will be automatically entered in the Drawing for the following Drawing Period, up till the end of the Extended Promotion Period, at which point, no more entries will be accepted.
  10. Release: By receipt of any prize, Winner agrees to release and hold harmless Sponsor, and their subsidiaries, affiliates, advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use or misuse of any prize.
  11. Publicity: Except where prohibited, participation in the Giveaway constitutes Winner’s consent to Sponsor’s and its agents’ use of Winner’s full name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
  12. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  13. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) unauthorized human intervention in any part of the entry process or the Giveaway; (3) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (4) late, lost, undeliverable, damaged or stolen mail; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, provided that, if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.
  14. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Utah Tenth Circuit or the appropriate Utah State Court located in Salt Lake County, Utah; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Utah without giving effect to any choice of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.
